Danville Kentucky Attorney FAQ

Frequently Asked Legal Questions

How much does it cost to hire an attorney in Danville KY?
Average rates depend on the legal services you are seeking. Some types of representation, such as personal injury cases, do not require a retainer. Others, such as divorce cases, will require a retainer (a partial prepayment for services). The amount of the retainer required is dependent upon the type of divorce you are facing. Uncontested divorces, for example, are usually less expensive than contested divorces involving child custody and property disagreements. Likewise, in criminal law cases, fewer legal hours are required to represent you in a misdemeanor case than in a felony case, thus the retainer required and the total legal costs will vary accordingly. Please call us to set up a free consultation to determine the legal costs of your particular case.
Do I have to go to court?
If you do not have an attorney or a lawyer, you must appear any time you are summoned to court. Period. Failure to do so can result in warrants for your arrest or rulings against you by default. If you have a question about your need for legal representation on a court summons or notice to appear, please contact a local lawyer in Danville or a Harrodsburg lawyer for cases in Boyle or Mercer Counties. For representation in other counties, please see our service areas to determine if we can help you, or call us and ask.
In a divorce, what does joint custody mean in Kentucky?
In Kentucky, joint custody is the first (and preferred) option for child custody. The courts believe that co-parenting, even in divorce cases, is preferable for the welfare of the children. Joint custody is the default. Only in cases when it can be proved to the court that the best interests of the child or children would not be served by a ruling for joint custody will another option be considered. If you have a child custody question in Kentucky, contact one of our Danville attorneys or Harrodsburg attorneys to schedule a free consultation. We are here to help you.
Do I need a lawyer?
In the state of Kentucky, you are not required, by law, to have an attorney. However, you are held to the same standard as a lawyer if you choose to represent yourself. If you have a question about your current need for professional legal representation, come in for a free consultation. One of our Danville Kentucky attorneys will help you to determine your best next steps. Realize that some individuals represent themselves with positive results, while others may make costly mistakes or end up with outcomes that are both heartbreaking and irreversible.
When should I contact a personal injury lawyer if I’ve been hurt in a car wreck?
As soon as someone is injured in a car wreck, in a slip and fall incident, or in any other incident involving personal injury, you should contact a lawyer. If you don’t understand the legal framework for personal injury cases, you can waive legal rights by waiting to file a claim. Your case may also become harder to prove if there is a delay and evidence is altered or lost. If you think you have a personal injury case, contact our Danville KY lawyers as soon as possible. We also have attorney offices in Harrodsburg, KY and can come to you, if you are unable to come to us.

Mrs. Hurst had the case thrown on her rather quickly and very late in the case. To her it was handled like she'd been hired since day one. Very efficient, very effective service. Would definitely recommend to anyone seeking a family lawyer.

Hurst and Hurst are my to go to attorneys. I wouldn’t choose anyone else above these guys. Some may ask why so here are my valid reasons:
    1. They are family people, they understand life’s obstacles and burdens. With their skilled knowledge there isn’t anything that can’t do or won’t be able to consider.
    2. Many attorneys leave you on a goose chase to do all the hard work or to just put you off and avoid you altogether. With Hurst and Hurst, if your case is not something they particularly practice law in they’ll reach out for you to someone who might be able to assist you.
    3. Hurst and Hurst, is just good for the community. If your looking for hardworking honest people with integrity look no further.

Boyle County has many reasons for community pride, the most recent being the young professional legal team of Hurst and Hurst. My husband and I had the pleasure of working with Rebecca Hurst, the estate planning side of the team where we were guided painlessly through the legal paperwork needed for living wills, health Proxys, and personal Wills. She tailored the documentation requirements professionally, expeditiously, in a friendly manner and offered a quick turn around time for a fair price. I can't say thank you enough for making light work out of what I was postponing. Thank you for choosing Boyle county to set up your practice. Wishing you both successful careers here in Danville, Rick and Laurel Adams

Pleading the 5th Amendment

What Does “Taking the 5th” Really Mean?

The Fifth Amendment actually includes several individual rights in both criminal and civil litigation. But most people know it as a right against making self-incriminating statements, or more simply the “right to remain silent.”
